Child custody comes in many forms and through various types of Courts depending on the specific situation. Custody can be awarded through different ways via different courts, such as Circuit, Family, or Probate Court. Custody can be modified under certain facts. “Primary” custody is no longer used. Custody is joint or sole for legal and physical, or a mixture of both. Sole custody is not awarded merely because the children reside with that parent.
